1. Acceptance of Terms

By accessing, browsing, registering on, or using the website and services of incrito ("Platform"), operated by Shrestha Cloud Solutions Pvt Limited ("Company", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms").

If you do not agree with any part of these Terms, you must discontinue your use of our platform and services immediately.

2. Services Offered

incrito provides an integrated digital platform for hackathons, quizzes, workshops, webinars, courses, skill-building programs, certificates, and college partnerships.

Shrestha Cloud Solutions Pvt Limited reserves the right to modify, suspend, upgrade, or discontinue any aspect or feature of the services at its discretion without prior liability.

3. User Eligibility & Account Responsibilities

• Eligibility: You must be at least 18 years of age, or legal age in your jurisdiction, or using the platform under parental/institutional supervision, to create an account and register for events.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials (email, password, OTPs). Any activity conducted through your account will be deemed your sole responsibility.
• Accurate Information: You agree to provide true, accurate, current, and complete details during registration and promptly update account information if changes occur.

4. Pricing, Billing & Payment Terms

Participation in certain workshops, masterclasses, webinars, and educational courses requires payment of applicable fees.

• Currency & Taxes: All prices listed on incrito are in Indian Rupees (INR) unless explicitly stated otherwise, and may be subject to applicable taxes as required under Indian law.
• Payment Processing: Online payments are processed securely via third-party payment gateway integration using Razorpay (Razorpay Software Private Limited). By completing a transaction, you authorize Shrestha Cloud Solutions Pvt Limited and Razorpay to charge your selected payment instrument.
• Price Adjustments: We reserve the right to revise pricing for future events, courses, or services at any time. Prices confirmed at the time of order placement remain fixed for that specific purchase.

5. Cancellation & Refunds

All course purchases, workshop registrations, and event enrollments are subject to our formal Cancellation & Refund Policy. Please review the Refund Policy for details on eligible cancellations, refund timelines (typically 5 to 7 working days via Razorpay), and process guidelines.

6. Intellectual Property Rights

All trademarks, logos (including incrito), content, code, software, graphics, user interfaces, course materials, video lectures, and documentation available on the platform are the exclusive intellectual property of Shrestha Cloud Solutions Pvt Limited or its licensors.

Users are granted a limited, non-exclusive, non-transferable, revocable license to access course materials for personal, non-commercial learning. You shall not copy, reproduce, retransmit, distribute, sell, frame, or reverse engineer any platform content without prior written permission from Shrestha Cloud Solutions Pvt Limited.

7. Code of Conduct & Prohibited Activities

When using the incrito platform, you agree NOT to:

• Submit plagiarized work, fraudulent submissions, or engage in unfair practices during hackathons and quizzes.
• Impersonate any person or entity, or falsely state or misrepresent affiliation with a person or institution.
• Upload viruses, malware, trojans, or malicious code designed to disrupt platform integrity or user security.
• Use automated scripts, bots, or scrapers to extract data without explicit permission.
• Post or transmit unlawful, harassing, defamatory, obscene, or abusive materials.

Shrestha Cloud Solutions Pvt Limited reserves the right to terminate or suspend accounts violating these guidelines without prior notice or refund.

8. Disclaimers & Limitation of Liability

The incrito platform and its content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by applicable Indian law, Shrestha Cloud Solutions Pvt Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or service interruption, arising out of or in connection with your use or inability to use the platform.

9. Indemnification

You agree to defend, indemnify, and hold harmless Shrestha Cloud Solutions Pvt Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the platform.

10. Governing Law & Judicial Jurisdiction

These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the laws of India.

Any legal action, suit, dispute, or proceeding arising out of or relating to these Terms or the incrito platform shall be subject to the exclusive jurisdiction of the competent courts located in Bangalore, Karnataka, India (Judiciary Bangalore India).
